CANCELLATION AND REFUND POLICY
Any Capitalized terms used but not defined herein shall have the meaning assigned to them under the Terms of Use which govern your use of our web portal https://servindia.co (the “Web Portal”) and our ‘ServIndia’ application for mobile and handheld devices (the “App”). The Web Portal and the App are jointly referred to as the “Platform”.
As a general rule customer shall not be entitled to cancel Service Request once placed. Customer may choose to cancel Service Request prior to appointment scheduling of Professional Visit or at the time of phone call received from ServIndia for appointment scheduling of Professional visit. However, subject to Customer’s previous cancellation history, ServIndia reserves the right to deny any refund to Customer pursuant to a cancellation initiated by Customer even if the same is within one-minute followed by suspension of account, as may be necessary in the sole discretion of ServIndia. If Customer cancels his/her Service Request after Scheduling Engineer Visit, ServIndia shall have a right to collect a penalty of 100% of the Service Request amount for breach of contract terms as a compensation for the damages suffered by ServIndia, with a right to either not to refund the Service Request
ServIndia reserves the right to collect a penalty for the Service Request constrained to be cancelled by ServIndia for reasons not attributable to ServIndia, including but not limited to: in the event if the address provided by Customer is either wrong or falls outside the service delivery zone; failure to contact Customer by phone at the time of Professional visit; failure to Professional visit due to lack of information, direction or authorization from customer at the time of delivery; In case of cancellations for the reasons attributable to ServIndia or it’s Partner. ServIndia shall not collect any penalty from the Customer. ServIndia reserves the right to look into the cancellation request of the Customer and determine if such cancelation request falls under the conditions mentioned above. If ServIndia is satisfied that the request and same fulfills any of the aforesaid conditions, then ServIndia shall process the cancellation request and refund amounts to the Customer.
Customer may be entitled to a refund for prepaid Service Request. ServIndia retains the right to retain the penalty payable by the Customer from the amount refundable to him/her. Customer may be entitled to a refund up to 100% of the Service Request value if Professional fails to deliver the Service Request due to a cause attributable to either Partner or ServIndia. However such refunds will be assessed on a case to case basis by ServIndia. Our decision on refunds shall be final and binding. All refund amounts shall be credited to Customer’s account as may be stipulated as per the payment mechanism of Customer’s choice, the estimated timelines is 5 to 7 working days. In case of payment at the time of service delivery, Customer will not be required to pay for it.
